1 – Purpose
The general terms and conditions of sale described below define the conditions applicable to any purchase made on the website www.alohawayoflife.fr (hereinafter referred to as the "seller"), and by its customer (hereinafter referred to as the "buyer").

The catalog and online store offer from Aloha Way of Life® is provided by SAS JAC&CO, headquartered at 28 Rue de Chatillon - 51500 SACY - France, and registered with the Reims Trade and Companies Register under the SIRET number: 823.238.134.

The seller reserves the right to modify its terms of sale at any time and without notice. In this case, the applicable terms shall be those in force on the date of the order by the buyer.

These General Terms and Conditions of Sale are intended to define the terms and conditions under which Aloha Way of Life® offers and sells its products.

2 – Placing an Order
To place an order, we offer you the following options:

Each order requires your acceptance of the General Terms and Conditions of Sale. By checking the corresponding box, you fully accept these conditions. Without such acceptance, no order can be validated.

Automated recording systems are considered as proof of the nature, content, and date of the Order.

The seller will confirm acceptance of the order to the customer by sending an email to the address provided by the latter.

The seller reserves the right to refuse or cancel any order from a customer, particularly in the event of the customer's insolvency, non-payment, or a dispute relating to the payment of a previous order.

The information provided by the buyer when entering the details of their order is binding. The seller cannot be held responsible for any errors made by the buyer in the wording of the recipient's contact details (especially delivery or billing addresses), nor for any delivery delays or inability to deliver the ordered products that may result from such errors.

3 – Products
The products offered for sale on the website www.alohawayoflife.fr are described and presented as accurately as possible. The photographs on the site are as faithful as possible but cannot guarantee a perfect similarity with the offered product; their appearance may vary, particularly regarding colors. The handcrafted nature of some items may also lead to variations in appearance (tolerance in the final product's look and design). The photos and video content showcasing the products are not contractually binding.

4 – Prices
The prices listed in the catalog and on the website www.alohawayoflife.fr are expressed in Euros and include all taxes (TTC), excluding shipping fees. Prices are subject to change at any time and without notice.

Shipping costs are specified on the order form before the order is validated.

The price is payable in full on the day of the order, and the prices applied are those in force at the time of the order.

The seller provides the following payment method:

  • Bank card via secure payment

5 – Shipping Fees: Conditions valid for delivery within Mainland France.

  • Free delivery to a Mondial Relay pickup point.
  • Home delivery via Colissimo without signature: + €4.50 incl. tax.
    Shipping fees are waived for orders over €95 incl. tax.

6 – Delivery
The delivery area corresponds to the geographical coverage of the offer (Mainland France).

Products are delivered to the address provided by the customer when placing the order, within Mainland France.

Orders are processed Monday through Friday, excluding public holidays.

The order will be fulfilled within a maximum of 3 business days from the day after the order has been definitively validated (payment received and order verification completed).

Delivery to a Mondial Relay pickup point: indicative timeframe +/- 3 to 4 business days.
Home delivery via Colissimo without signature: indicative timeframe +/- 2 to 3 business days.
The customer must ensure that all access conditions for the delivery location (access code, building, floor, etc.) as well as a reachable phone number are properly entered. Deliveries are made from Monday to Saturday morning, excluding public holidays.

In case of absence during delivery, a delivery notice will be left at the address provided by the client, allowing them to collect the package from the nearest post office. Parcels are held at the post office for 15 calendar days. If not collected within the timeframe specified by the carrier, the products will be returned to JAC&Co, which reserves the right to refund only the product price, with shipping fees remaining the responsibility of the client.

Delivery times are given for information only and are not guaranteed. They may not give rise to cancellation of the order or to any claims for damages in the event of delay due to any circumstance.

In all cases, delivery within the agreed timeframe is conditional on the buyer having fulfilled their obligations toward us, regardless of the reason for any potential failure.

The customer is responsible for the completeness and accuracy of the information (delivery address, pickup point, bank details, delivery constraints, etc.) validated when placing the order. SAS JAC&CO cannot be held responsible for being unable to deliver the product due to incorrect or incomplete information.

The risk of transport is borne entirely by the recipient.

Delivery is deemed completed once the product has been handed over to the carrier.

In case of damage, total or partial loss, or other issues, it is the buyer's responsibility to file claims with the carrier, and the seller cannot be held liable.

In the event of missing or damaged goods, the buyer must note any necessary reservations on the delivery slip upon receipt of the goods. These reservations must also be confirmed in writing within five days of delivery by registered mail with acknowledgment of receipt. It is the recipient’s responsibility to check the condition of the package in the presence of the delivery person. Any anomaly upon delivery must be reported to the carrier to initiate a refund process.

An investigation with Colissimo or Mondial Relay may take up to 21 business days. If the product is located during this time, it will be immediately resent to the delivery address indicated on the order form.

However, if the product is not found after the 21-day investigation, the order will be resent to the customer at no additional charge.

If the ordered product is no longer available, the seller will refund the unavailable item.

In the case of a product exchange, shipping costs will be borne by the customer.

7 – Right of Withdrawal
In accordance with Article L.121-21 of the French Consumer Code, you have a 15-day withdrawal period from the date of receipt of your products to exercise your right of withdrawal, without having to justify any reason or pay any penalty. Returns must be made in their original condition and complete (packaging, accessories, instructions), in a resaleable state: not damaged, deteriorated, or soiled by the buyer. Within this framework, you are liable for any damage. Any damage suffered by the product during this process may result in the failure of the withdrawal right. Any obvious prolonged use of the product (beyond a few minutes) cannot be subject to a refund.

The return must be made without undue delay and, in any event, no later than 15 days after you have informed the seller of your decision to withdraw from this contract. This period is deemed to be respected if you send back the item before the 15-day deadline expires.

Return shipping costs are the responsibility of the buyer.

If the right of withdrawal is exercised, the seller will refund the amounts paid within 15 days of receiving the returned parcel.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with Article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to:

  • The supply of services fully performed before the end of the withdrawal period and whose performance began after prior express consent of the consumer and express waiver of their right of withdrawal.
  • The supply of goods or services whose price depends on fluctuations in the financial market beyond the professional’s control and likely to occur during the withdrawal period.
  • The supply of goods made to the consumer’s specifications or clearly personalized.
  • The supply of goods that are likely to deteriorate or expire rapidly.
  • The supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.
  • The supply of goods which, after being delivered and by their nature, are inseparably mixed with other items.

8 – Defective Products and Returns
For all product returns, shipping costs are the responsibility of the customer, except for returns related to non-conforming products (wrong item received: color, size, model mismatch, incorrect pattern, damaged products). Your order will then be redone and resent at the seller’s expense after verifying your order form.

Important: Items must not have been used or damaged in any way and must be returned with their original packaging.

The refund will be issued automatically to the bank card used for payment.

9 – Intellectual Property and Copyright
SAS JAC&CO holds the intellectual property rights of the website and catalog www.alohawayoflife.fr, including the right to distribute the elements, notably photographs, for which it has obtained the necessary authorizations from the concerned parties. As a result, the partial or complete reproduction of any element of the website or catalog, on any medium, their use, and their provision to third parties are strictly prohibited. Photos, images, and mockups are non-contractual.

The designs, images, and texts of the website www.alohawayoflife.fr and the catalog are the full property of SAS JAC&CO. Any reproduction, use, or copying without our prior agreement will result in legal action.

These general terms and conditions express the entirety of the parties’ obligations. No other general or specific condition communicated by the buyer can be incorporated into or deviate from these general conditions.

Aloha Way of Life® is a registered trademark. As such, all content of its online store is its property. Copyright protection and Intellectual Property Code provisions regarding trademarks prohibit copying or reproducing in any way the models presented by Aloha Way of Life®, which holds all associated rights.

Therefore, any production or minor transformation of similar products for commercial or personal use is prohibited. Violating these rights constitutes copyright and Intellectual Property infringement and subjects the responsible party to applicable civil and criminal penalties.

10 – Liability
The seller cannot be held liable if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions is due to a force majeure event.

Force majeure is defined as any external, unforeseeable, and irresistible event as per Article 1148 of the Civil Code.

The seller also cannot be held liable in case of disruption or total or partial strike of postal services.

11 – Data Protection Law

Applicable Law and Jurisdiction
The language of this contract is French. These terms and conditions of sale are governed by French law. In the event of a dispute, only French courts shall have jurisdiction.
